Benjamin "Tom" Pugh was admitted to practice in 2010 and is a Founding Partner of Pugh & Roach, Attorneys at Law, PLLC. He is licensed in both Ohio and Kentucky. Tom has extensive insurance experience after spending three years in the industry. During law school, he externed with the Kentucky Department of Public Advocacy serving in the Kentucky Innocence Project.

Q. Community Service for "Drivers License Not On Person"?? Do I need this expunged? Is this a serious charge?

A: So, if your charges are indeed dismissed, you have the option to have the charge expunged 60 days after dismissal. You can pay a lawyer to do it, or you can try to do it yourself. You'll need to get a KSP certification first, that the charge is eligible for expungement. Her is a link for that: https://kycourts.gov/Expungement/Pages/process.aspx. It costs $40. Follow the instructions. As soon as you get the certification, you have I think 30 days to file a petition for expungement in the county where the charge is. A: It sounds like you have what is called a PIP application. The car you were traveling in is covered by Personal Injury Protection (PIP) insurance, which covers the first $10,000 of medical bills, and a small portion of any lost wages. If you have injuries, I would speak with a personal injury attorney, as it gets complicated. The coal truck's insurance carrier will handle any pain and suffering award, plus anything that exceeds the PIP coverage. First things first, get your PIP application in so you can have your doctor's visits and hospital visits covered. Then, I would strongly recommend speaking with a personal injury attorney. A: If the other party is at fault, then you must submit a claim to the other party's insurance carrier. The insurance company will then either fix your car or "total" it out and pay you the fair market value. If you have full coverage insurance, you can submit the claim to your insurance carrier, and have them deal with the repairs, less whatever your deductible is. If you have injuries, or any passenger has injuries, you need to submit a claim to your insurance carrier for PIP/BRB (personal injury protection/basic reparation benefits) and your insurance will pay the first $10,000 of medical bills, and a portion of lost wages.
